1. Agreement to Terms

By accessing or using Thita.ai (the "Service"), you confirm that you are at least 18 years of age, have read and understood these Terms of Service ("Terms"), and agree to be legally bound by them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Thita.ai is an AI-powered interview preparation platform that provides:

• Structured learning paths and DSA pattern sheets
• AI-driven mock interviews with real-time voice feedback
• System design case studies and guided preparation
• Resume analysis and optimisation powered by AI
• Progress analytics and personalised study plans

The Service is intended to assist with interview preparation. We do not guarantee any specific outcome, including job placement or interview success. AI-generated feedback is assistive in nature and should not be treated as professional career advice.

3. Accounts and Registration

To access premium features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your credentials confidential and not share them with any third party
• Notify us immediately at team@thita.ai of any unauthorised access to your account

You are solely responsible for all activity that occurs under your account. We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where required by law.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Reproduce, distribute, or create derivative works from any part of the Service without prior written consent
• Reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of the Service
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service
• Upload or transmit viruses, malware, or any code designed to interfere with the Service
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Use the Service to impersonate another person or misrepresent your affiliation with any entity
• Share your account with others to circumvent subscription limits
• Use AI-generated interview feedback to deceive employers or misrepresent your capabilities

Violation of these provisions may result in immediate account suspension or termination without refund.

5. Subscriptions and Billing

Certain features of the Service require a paid subscription. By subscribing, you authorise us to charge your payment method on a recurring basis (monthly or annually, as selected) until you cancel.

• Billing occurs at the start of each billing cycle
• Prices are displayed inclusive of applicable taxes where required by law
• We reserve the right to modify pricing with at least 30 days' advance notice
• Continued use of the Service after a price change constitutes acceptance of the new pricing

6. Intellectual Property

All content, features, and functionality of the Service — including DSA content, system design materials, AI models, and software — are the exclusive property of Thita.ai or its licensors and are protected by applicable intellectual property laws.

You retain ownership of content you submit (such as your resume or code). By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, process, and store that content solely to provide and improve the Service.

AI-generated feedback and outputs produced during your sessions are provided for your personal use only and may not be redistributed or commercialised.

7. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described therein. Audio recordings from mock interview sessions are processed solely to generate feedback and are not retained beyond the period described in the Privacy Policy.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI-generated feedback will be accurate or complete; or (c) the Service will meet your individual requirements or produce any particular interview outcome.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Thita.ai and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or relating to your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not permit certain exclusions or limitations, so the above may not apply to you to the extent prohibited by law.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we determine that termination is otherwise warranted. You may delete your account at any time through your account settings. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — shall survive.

11. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.

If you are a consumer in a jurisdiction with mandatory local consumer protection laws, those laws may afford you additional rights that these Terms cannot override.

12. Changes to These Terms

We may update these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the Service. Continued use after the effective date of revised Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription per our Refunds Policy.
